Local Teacher Indicted On Sex Charges

Danny Cuesta, a teacher at a Babylon Town school, is being charged with criminal sexual acts in the third degree and other sexual offenses, according to Bob Clifford, spokesman for District Attorney Thomas Spota.
According to the DA¡¦s office, Cuesta, of 19 Folsom Lane in Coram, was arrested by the Suffolk County Police Department on August 29 for allegedly committing sexual crimes against a female under the age of 17.
Cuesta was arraigned at First District Court in Central Islip on August 30, where he pled not guilty, according to Clifford, with bail set at $105,000. At the arraignment, he was charged with 16 counts of criminal sexual acts in the third degree, nine counts of rape in the third degree, two counts of sodomy in the third degree and one count of endangering the welfare of a child, according to the indictment.
According to Clifford, rape in the third degree is a criminal charge based on the age of the offender being over 21 years old and the victim being under the age of 17. When the victim is under 17, according to New York State law, they are not legally capable of having consensual sexual relations.
Both the rape in the third degree and criminal sexual act in the third degree charges are E felonies, Clifford noted, punishable by one-and-a-half to four years in prison upon conviction.
Cuesta¡¦s next court date is scheduled for October 14 at the Suffolk County Court in Riverhead.
In a statement, Cuesta¡¦s lawyer, Lawrence Silverman, responded to the allegations. ¡§We want the public to know that the complainant in this case has previously given a statement to law enforcement investigators that none of these incidents ever happened,¡¨ Silverman stated.
Cuesta reportedly also went under the alias of Danny Rivera. The SCPD, in coordination with the Domestic Violence and Child Abuse Bureau, are pursuing further investigation of the matter. The district attorney¡¦s office is asking anyone who has reason to believe someone else may have been victimized to call the DA¡¦s office at 852-2500 or the Domestic Violence and Child Abuse Bureau at 852-2555.

Teacher admits to rape following hung jury

Five days after his statutory rape trial ended with a hung jury, former North Babylon High School teacher Danny Cuesta admitted in court Wednesday that he had sex with an underaged student.
Prosecutors also revealed in court that two other girls have come forward, saying Cuesta had sex with them.
With his accuser watching from the court gallery, Danny Cuesta, 30, of Coram, pleaded guilty to one count of third-degree rape, two counts of third-degree criminal sexual act and one count of endangering the welfare of the child. In exchange for his plea, prosecutors recommended a sentence of 15 months in jail. Suffolk County Court Judge C. Randall Hinrichs will sentence him Jan. 4.
Attorneys in the case said they also expect Cuesta to receive a concurrent 1-year sentence from Nassau prosecutors for pleading guilty to an indictment charging that Cuesta had sex with the girl in a Nassau motel.
Suffolk Assistant District Attorney Rosamaria Abbate said she was satisfied that Cuesta "came into a courtroom and admitted exactly what he did to" the girl, whom Newsday is not naming. Hinrichs also granted a permanent order of protection for the girl, and certified Cuesta as a sex offender.
In their 28-count indictment, prosecutors charged Cuesta with having sex with the girl, whom he met at school, when she was as young as 15. They say he hid the relationship by posing as the girl's academic mentor. Cuesta said he had been framed by the girl, now 19, and her father, who hoped to win millions by suing the school district.
After four weeks of testimony, Hinrichs declared a mistrial Friday after jurors could not reach a unanimous verdict.
Wednesday, Cuesta rubbed his face, bit his lip, and occasionally shook his head as he admitted -- with short answers of "Yes" -- to a two-year sexual relationship with the girl.
Prosecutors also said that as part of the plea deal, they would drop a pending investigation into charges by two other girls that Cuesta had sex with them.
Cuesta and his attorney, Laurence Silverman of Huntington, declined comment after the plea.
Upon hearing Cuesta say "guilty" in entering his plea, the girl began quietly weeping in court. Her father braced her head on his shoulder and later said he was proud of his daughter for standing up to Cuesta.
"We knew he was guilty from the start," the girl's father said. "I guess the walls closed in on him."
